Terms of Sale
Purchases through Pop-the-top Trading Post must be paid for at time of purchase, unless other arrangements have been made. You may choose one of the many payment options we have available at time of checkout. We will not ship COD. All shipping costs will be included in the invoice. Pop-the-top Trading Post reserves the right to IMMEDIATELY withhold shipments in the event that customer fails to comply with agreed upon terms of sale. All check payments must be made payable to Scott Moore. There will be a 7 to 10 business day hold for all check payments to clear our bank before shipping. We can drop-ship (ship to any other address in the US other than your billing address) your order for your added convenience.
Pricing
All pricing is subject to change without notice as our suppliers adjust our prices. This is out of our control. If an order has been paced, processed and then shipped within 48 hours of any lower price adjustments, said order will be adjusted and any amount owed to the customer will be refunded in the form of their payment that was submitted when the order was placed.
Backorders
We try to keep an ample supply of all our products. All items in stock are shipped at time of order. Out of stock items will be placed on backorder and the customer will be notified. All backorder items will be shipped at the time the product becomes available. If backorder period exceeds 30 days, we will notify the customer prior to shipment release. Backorders are shipped at prices in effect when the item was ordered. Most all backordered items are shipped within 7 to 14 business days.
Cancellations
All orders (including backorders) may be cancelled with no additional fee prior to shipping. Orders are shipped when shipping labels and tracking numbers have been generated. Cancellations must be made by emailing our or by fax at 419-710-5712. WE WILL NOT CANCEL AN ORDER OVER THE PHONE. If order has been shipped, it may be returned following the return guidelines listed to the left.
Warranties
All warranties for products purchased through Pop-the-top Trading Post are the responsibility of the respective manufacturers. All issues, claims and questions concerning product warranties should be submitted directly to the manufacturers. In the event that the product is a health related device or nutritional supplement, all information contained on the website, including information relating to medical and health conditions, products and treatments, is for informational purposes only. The information on the Pop-the-top Trading Post's website, or information provided by the manufacturers of the products, or information on product packaging or labels is not meant to be a substitute for the advice of a physician or other medical professional and should not be used for prescribing a medication or diagnosing a health problem. Statements regarding dietary supplements have not been evaluated by the Food and Drug Administration and are not intended to diagnose, treat, cure, or prevent any disease.
Limitation of Liability
Under no circumstances shall Pop-the-top Trading Post or any other party involved in creating, distributing, or supplying products for Pop-the-top Trading Post be liable for any direct, indirect, incidental, special, or consequential damages that result from products purchased from Pop-the-top Trading Post, the use or inability to use the site, the cost of procurement of substitute goods and services, unauthorized access to or alteration of your transmissions or data, statements or conduct of any third party on the site. You hereby acknowledge that this paragraph shall apply to all content, merchandise, and services available through the website. In the event that your state does not allow the exclusion or limitation of liability for damages, in such states liability is limited to the fullest extent permitted by law.
Indemnification
You agree to indemnify and hold us, and our subsidiaries, affiliates, officers, directors, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content that is taken from and or utilized from the Pop-the-top Trading Post website.
